He was admitted to the West Virginia State Bar in 1980 and is admitted to practice before the United States District Court for the Southern District of West Virginia and the Fourth Circuit Court of Appeals. Dave obtained his law degree from West Virginia University College of Law and his Bachelor's Degree in Economics from Hampden-Sydney College in Virginia.
