Mediation & Alternative Dispute Resolution
West Virginia Lawyers: Arbitration and Mediation
Responsible Attorney: Robert P. Martin
Litigation is not always the most effective way to handle a legal dispute. In fact, many cases can be resolved efficiently and cost-effectively by using alternative dispute resolution (ADR) techniques, such as arbitration or mediation. At the law firm of Bailey & Wyant, we are attorneys, but we are also licensed mediators and arbitrators who understand the true value of these techniques. We are able to work with you to determine if alternative dispute resolution is the most appropriate path to resolve your dispute, and then will aggressively pursue resolving your matter.

At Bailey & Wyant, we are able to serve clients throughout the State of West Virginia. We can resolve disputes among individuals, businesses, government bodies, insurance companies, and anyone else involved in any type of lawsuit.
Because some disputes cannot be resolved by negotiating a settlement, many claims will end up being litigated. Unfortunately, litigation is often time-consuming and costly by nature. As a result, ADR is an excellent alternative to standard litigation.
Arbitration is similar to trial. An arbitrator serves as a judge. This person typically has a great wealth of legal experience to draw from. He or she weighs the case that is presented by each side and decides the outcome. While some degree of the formality of litigation is preserved, it does not require the formality of a courtroom and jury. Moreover, arbitration is done in private, without an audience or the media. It generally takes much less time and is less costly.
Mediation is another form of alternative dispute resolution. Unlike arbitration, this form is more similar to the settlement process. The mediator works with the two opposing parties, usually separated, to facilitate a mutually agreed upon outcome. This option puts the power into the hands of those involved, rather than a judge and jury.
Alternative dispute resolution can be used to resolve business disputes, employment law disputes, insurance law conflicts, and almost every other type of civil law matter.
