LeMasters successfully obtained the dismissal of the Client University Healthcare Physicians, Inc. from a wrongful death / medical malpractice action filed against it in the Circuit Court of Berkeley County, West Virginia. After the Circuit Court granted the Client's Motion to Dismiss, Plaintiff appealed to the West Virginia Supreme Court. Recently, the West Virginia Supreme Court issued a Memorandum Decision affirming the Circuit Court of Berkeley County's Order granting Client University Healthcare Physicians, Inc.'s Motion to Dismiss and denial of Plaintiff's Rule 59(e) motions.
